Terms Of Service

WinFit Fitness Club
A Sole Proprietorship Registered in Mumbai, India.
Effective Date: 27th September 2025.

1. Acceptance of Terms
By accessing or using the services provided by WinFit Fitness Club (“we”, “us”, “our”), including but not limited to personal coaching, diet recommendations, and lifestyle change guidance (“Services”), you (“User”, “you”, “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our Services.

2. Eligibility
You must be at least 18 years of age to use our Services. If you are under 18, you may only use our Services with the written consent of your parent or legal guardian, which must be provided to us prior to registration.

 

3. Services Offered
WinFit Fitness Club offers personal fitness coaching, diet recommendations, and lifestyle change guidance through online platforms. Services may be delivered via live sessions, recorded content, or other digital means.

 

4. User Responsibility and Obligations
You agree to provide accurate, current, and complete information as required for registration and during the use of our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.


i) Health and Safety Obligations:
You are solely responsible for assessing your physical fitness and health status. You must obtain medical clearance from qualified healthcare providers before commencing any fitness program. You agree to immediately cease any exercise causing pain, discomfort, or adverse reactions. You acknowledge that participation in fitness activities carries inherent risks.

 

ii) Information Accuracy:
You must provide complete, accurate, and current information during consultation. You must promptly notify us of any changes in health status, medications, or physical limitations. False or misleading information may result in program termination without refund.

 

iii) Program Compliance:
You agree to follow program guidelines as designed and delivered. Modifications to the program should be discussed and approved during scheduled interactions. Failure to follow program guidelines may affect results and warranty coverage.

 

5. Payment Terms
All payments for Services must be made through the payment methods provided on our platform, including credit/debit cards, UPI, PayPal, and other methods supported by Razorpay. You agree to pay all applicable fees as per the pricing displayed at the time of purchase.

 

6. Refund Policy
Our “No Result, Full Refund” policy applies only if you experience no changes, including physical, emotional, or otherwise, after following the prescribed program in good faith. Refund requests must be submitted in writing to winfit.club@gmail.com within 7 days of program completion, along with supporting evidence. Refunds are subject to verification and approval at our sole discretion.

 

7. User Conduct
You agree not to misuse the Services, including but not limited to:
a) Sharing login credentials or program access with third parties;
b) Recording, screenshotting, or copying program content for distribution;
c) Reverse engineering or attempting to extract proprietary methodologies;
d) Using content for commercial purposes or competitive activities;
e) Providing false or misleading information;
b) Engaging in unlawful, harmful, or abusive behaviour;
c) Violating any applicable laws or regulations.

 

8. Health Disclaimers and Risk Acknowledgment
i) Medical Disclaimer:
WinFit Fitness Club is not a licensed medical practitioners. Our services are educational and motivational in nature, not medical treatment. We do not diagnose, treat, cure, or prevent any medical conditions. All health-related decisions remain your sole responsibility.

 

ii) Risk Acknowledgment:
You acknowledge that physical exercise and fitness activities involve inherent risks. Risks may include but are not limited to: muscle strains, joint injuries, cardiovascular stress, and other physical harm. You voluntarily assume all risks associated with program participation. You waive any claims against us for injuries or health complications arising from program participation.

 

iii) Pre-existing Conditions:
You must disclose all medical conditions, injuries, medications, and physical limitations. Pregnancy, cardiac conditions, joint problems, and other health issues require medical clearance. Failure to disclose relevant health information releases us from any related liability.

 

9. Intellectual Property
All content, materials, and intellectual property provided by WinFit Fitness Club remain our exclusive property. You receive a limited, personal, non-exclusive, non-transferable license to access and use program materials. You may not reproduce, distribute, or create derivative works without our express written consent.

 

10. Limitation of Liability
To the maximum extent permitted by law, WinFit Fitness Club shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount paid by you for the Services.

11. Indemnification
You agree to indemnify and hold harmless WinFit Fitness Club, its proprietors, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.

 

11. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of the Services constitutes acceptance of the revised Terms. You may terminate services if you disagree with material modifications.
We reserve the right to modify, suspend, or discontinue a service or program with reasonable notice. Price changes apply to future purchases only, not existing program commitments.


12. Termination
a) Termination by Client:
You may terminate services subject to our refund and cancellation policy. Termination requests must be submitted in writing to our official email address. Access to materials and app may be revoked upon termination.

 

b) Termination by Company:
We may terminate services immediately for material breach of these terms. Grounds for termination include fraud, abusive behaviour, intellectual property safety concerns. Terminated clients are not eligible for refund except as required by law.

 

12. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.
