Refund Policy
WinFit Fitness Club
A Sole Proprietorship Registered in Mumbai, India
Effective Date: 27th September 2025.
1. Standard Cancellation Policy
a) Pre-Consultation Cancellations: Full refund minus processing charges (if any) within 7 days of payment.
b) Post-Consultation Cancellations: No refund except under the "No Results – Full Refund" guarantee.
c) Medical Emergency Cancellations: Partial refunds considered with medical documentation.
2. No Results - Full Refund Guarantee:
This guarantee applies exclusively to programs of 3-months or longer duration, subject to the following conditions:
a) You must complete the full program duration as designed and delivered;
b) You must attend all scheduled consultation calls and check-ins;
c) You must provide documented evidence of program adherence (workout logs, progress photos, measurements);
d) You must demonstrate good faith effort in following nutrition and lifestyle change recommendations.
e) You must submit a written refund request to winfit.club@gmail.com within 7 days of program completion.
WinFit Fitness Club is committed to client satisfaction. If you do not experience any changes, including physical, emotional, or otherwise, after following the prescribed program in good faith, you may be eligible for a full refund.
Results Definition:
"Results" means measurable improvement in at least one of the following areas:
a) Physical strength or endurance improvements;
b) Body composition changes (weight, measurements, body fat percentage);
c) Fitness performance metrics;
d) Overall energy levels and wellbeing (as reasonably assessable)
3. Refund Claim Process:
That to qualify for a refund claim:
a) You must have completed the program as instructed and adhered to all recommendations;
b) You must submit a written refund request to winfit.club@gmail.com within the mentioned time frame;
c) You must provide supporting evidence demonstrating program adherence and that no changes were seen as a result of the program.
4. Verification Process
That all refund requests are subject to verification. We may require additional information or documentation to assess your claim. Refund decisions will be communicated within 30 days of claim submission. Refunds are granted at our sole discretion.
5. Exclusions
That refunds will not be provided in the following circumstances:
a) Programs shorter than 3 months duration
b) Failure to follow the program or recommendations;
c) Non-disclosure of relevant health information affecting results;
d) Unrealistic expectations inconsistent with program design;
e) External factors beyond program scope (medical conditions, medications, major life events)
f) Incomplete participation in the program;
g) Requests made after the specified period;
h) Any misuse or abuse of the refund policy.
6. Refund Method
That approved refunds will be processed to the original payment method used at the time of purchase. Processing times may vary depending on your payment provider.
7. Limitation of Liability
Our total liability to you for all claims arising from or related to these services shall not exceed the amount paid by you for the specific program. This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise)
8. Excluded Damages:
We shall not be liable for indirect, incidental, special, consequential, or punitive damages. This includes but is not limited to lost profits, lost time, emotional distress, or opportunity costs. These exclusions apply even if we have been advised of the possibility of such damages.
9. Force Majeure:
We are not liable for delays or failures in service delivery due to circumstances beyond our reasonable control. This includes natural disasters, government actions, technical failures, or other unforeseeable events.
